DROP CHARGE

Owner, authorized operator, or authorized agent of the owner of a motor vehicle appears in person to retrieve the motor vehicle after it has been hooked up, but before it has been removed from the property.

As of August 10, 2022, towing carriers can no longer assess a drop fee related to a tow from residential private property, pursuant to § 40-10.1-405(6), (9), C.R.S. (see HB22-1314).

PRIVATE PROPERTY IMPOUND (PPI) – BASE RATE (AKA “HOOK FEE”)

Maximum rates for a nonconsensual tow from private property upon authorization of the property owner.

As of August 10, 2022, vehicles towed from residential private property may be subject to release without full payment, pursuant to § 40-10.1-405(5)(c), C.R.S. (see HB22-1314).

MILEAGE / FUEL SURCHARGE

Description: Mileage charge a towing carrier may assess for a PPI tow, up to 12 miles for tows within 10 miles of I-25 or up to 16.5 miles for tows farther than 10 miles of I-25. Fuel Surcharge may be assessed when the price per gallon of diesel fuel exceeds $2.60.

LAW ENFORCEMENT-ORDERED TOW & RECOVERY OPERATIONS

Maximum rates for a law enforcement-ordered tow and recovery operations, calculated on an hourly basis (billable in 1⁄4 hour increments after the first hour), per required tow truck/driver.

A towing carrier may also bill for the actual and reasonable cost of recovery equipment and labor, in excess of one tow truck/driver for one hour, plus an additional 25% of those actual and reasonable costs (see 6511(c)(IV)(D)).

RELEASE OF PERSONAL PROPERTY

Description: Maximum rates for a towing carrier to charge for the release of personal property from a towed vehicle. The request for the release of personal property must be made within 30 days of statutory notification.

STORAGE

Storage charges may accrue from the time a motor vehicle is placed in storage, based on a 24-hour period or any portion of a 24-hour period.


Applicable Rule(s): 6511(d)(I)


As of August 10, 2022, towing carrier can no longer accrue storage for private property tows (except the first 24 hours) until statutory notification has been completed (see HB22-1314).

AFTER HOURS

Maximum additional charge for release of a motor vehicle from storage at any time other than the towing carrier's business hours, typically 8:00 AM to 5:00 PM, Monday through Friday, excluding legal holidays.

STATUTORY NOTIFICATION

Description: Between 2-10 days after a vehicle has been towed, a towing carrier is required to notify any owner(s) and lienholder(s) related to the vehicle. This fee may be assessed if the title search has been performed and the required mailings have been sent.
